Cell Phones and Crashes and Cars, Oh My!

We all know by now how fatally dangerous driving and texting or using a cell phone can be. But lo and behold, doesn’t it seem like every time you go for even a short ride, you see a fellow driver jeopardizing the safety of everyone around them because they just can’t wait until they’re safely pulled over to check that text or pick up that call?

If you ask me, the world needs to relax and slow down a little. But it doesn’t seem like that’s going to happen, so the best you can do is know the facts and use your judgement to try and prevent becoming a part of a cell-phone related auto accident.

Yes, most people know me as the workers' compensation lawyer from Atlanta, but I also specialize in auto accidents. With that said, let’s review some information about phones and cars. Spoiler alert, they mix about as well as oil and water:

Cell Phone Laws in Georgia

Did you know? Traffic fatalities are on the rise in Georgia, and the DOT attributes that increase to distracted driving

Drivers under 18 are prohibited from using cell phones of any kind (including hands free devices) while operating their vehicles. No one of any age can text message, use computers (including smartphones) or send internet data while they’re behind the wheel. School bus operators may not talk on cell phones while carrying passengers.

Stats

  • There were over 2,250 distracted driving convictions in Georgia in 2014
  • There have been over 8,000 total convictions since the distracted driving ban was passed in 2010.
  • Nationally, in a CDC report, 69% of drivers (18-64) said they had talked on a cell phone while driving within 30 days of the report.
  • According to the same report, 31% of drivers said they had sent or read a read a text or email while driving within 30 days of the report.

Fines

    • If convicted of texting while driving: $150 + 1 point
    • Drivers under 18 using cell phone while driving : $150
  • POSSIBLY YOUR LIFE

The last one isn’t a part of any legislation of course, but it’s still a very plausible outcome of making the decision to distract yourself while driving.
