Can I be paid unemployment and workers’ compensation at the same time?The similarities between unemployment and workers’ compensation are that they both provide money for those who are out of work. They are also similar in that if a worker voluntarily quits his or her job, that worker may not be entitled to either workers’ comp or unemployment. Aside from these similarities, unemployment and workers’ compensation are quite different. If you are laid off due to reasons that are not your fault and are not terminated for cause, you may be eligible for unemployment. The maximum benefit in the state of Georgia for unemployment is $330 per week, for only 20 weeks. While on unemployment you must be actively seeking employment and must be physically able to work. To receive Georgia workers’ compensation benefits you must have been injured on the job or developed a work-related illness. Your injury or illness must be serious enough that your authorized WC treating physician has taken you out of work or placed you on light duty restrictions that your employer is unable to meet. There is a 400-week cap on non-catastrophic workers’ compensation claims. You may wonder whether you could receive both unemployment and workers’ comp benefits at the same time. While technically, this is possible, in practice it is not advisable. WC insurers take a credit via a WC-243 form for any money you receive. This precludes any injured worker from receiving more than $675 per week, so you could conceivably jeopardize your WC benefits by receiving unemployment benefits.

What if my employer does not carry workers’ compensation insurance?Since most employers in Georgia are required to carry WC insurance, if your employer should have workers’ compensation coverage—but does not—you may be unsure of what you should do. The fact that your employer chose not to follow the law does not automatically mean you are out of luck as far as WC benefits following an on-the-job injury.
