Roswell Workers’ Compensation Attorney

Workers Comp Lawyer in Roswell, GA

If you have been injured while on the job in Roswell, GA or you have developed an occupational disease as a result of your workplace environment, you can file a workers’ compensation claim. Although workers’ compensation claims are meant to pay employees for work-related injuries and illnesses, regardless of fault, some insurers balk at paying legitimate claims, attempting to show the accident or illness was not work-related. For this reason, and because the filing process can sometimes be complex, it can be beneficial to speak to a Roswell workers’ compensation attorney who can guide you through the process or assist you with an appeal.

About Roswell, GA

Roswell is a city in northern Fulton County, Georgia. As of 2019, the population in Roswell was about 95,000, making it the ninth-largest city in the state of Georgia. Roswell is a close suburb of Atlanta, boasting an affluent historic district. In 1830, Roswell King passed through this area, observing the potential for building a cotton mill along Vickery Creek.

King eventually returned to build that mill (Roswell Mill) that would soon become the largest in northern Georgia. King invited coastal investors to join him at this new location and was joined by one of his sons, Barrington King. By the time of the Civil War, the cotton mills employed more than 400 people, mostly women, with many of Scots-Irish descent.

Today, the city’s largest employers are The Kimberly Clark Corporation, North Fulton Regional Hospital, and Harry’s Farmer’s Market. There is a section of Route 400 between Atlanta and Roswell that is known as the “high-tech corridor,” because it is home to many technology firms. A few of the famous people from Roswell include Jerome Bettis, former Pittsburgh Steeler, David Cross, comedian, television, and film actor, writer and director, and former President Jimmy Carter’s aunt, Emily Dolvin.

    FAQ's

Regarding Georgia Workers’ Compensation in Roswell, GA:

    • Is it too late for me to file my workers’ comp case?
Following an injury at work or the discovery of a work-related illness, you have thirty days to let your employer know about the injury. While you do have 30 days, the sooner you report the injury, the better your chances of receiving your workers’ compensation benefits. When you wait to report your work-related injury or illness you risk the insurer saying you were injured elsewhere rather than at work. As far as bringing a lawsuit against your employer or the insurer, this is governed by the Georgia statutes of limitations, although there are certain exceptions. If you have received no medical treatment and no benefits, you have one year from the date you were injured on the job to file notices with the Georgia SBWC. If you are receiving a weekly WC check, then you have two years from the date of the last weekly income check received to file with the SBWC. If, following your work-related injury, you are sent to a doctor by your employer or insurer, you have one year from the date of that treatment to file notice with the SBWC. If you have a work-related disease, you have one year from the date you first became aware of the disease (unless it has been longer than 7 years from exposure) to file with the SBWC. If an individual is killed while on the job, the heirs must file notice with the SBWC within one year from the death.
    • Do I Really Need a Roswell Workers’ Compensation Attorney?
When you hire a Roswell workers’ compensation attorney, your attorney takes all the risk. If they do not recover a settlement in your favor, they collect nothing. Your attorney only gets paid if they win. Plus, having an experienced workers’ comp attorney by your side means your claim can more accurately be valued. If you were hurt at work, your claim might be straightforward—or it might not be. Your employer could deny your claim, you could be released back to work before you are ready, there could be a dispute over whether your own misconduct was responsible for your accident, or a dispute over whether or not you were performing job duties when you were injured. In any of these situations, your claim becomes much more complex, meaning your interests are best served by having a professional Roswell worker’s compensation attorney to help maximize your claim.
