Warner Robins Workers’ Compensation Attorney
Work Injury Lawyer in Warner Robins, GA
There are many different reasons why your application for workers’ compensation could be denied—and sometimes your benefits can be denied for no good reason at all. A perfectly legitimate claim can be delayed or denied by your employer or their insurer, requiring that you hire a Warner Robins workers’ compensation attorney to ensure your rights are protected. Insurers or your employer could deny your claim for any of the following reasons:
- You failed to immediately report your workplace injury
- There were no witnesses to your accident
- The accident report and initial medical records show discrepancies
- Your initial medical records show the presence of illegal drugs in your system
- The workers’ compensation claim was filed after you were laid off or fired
- You refused to sign a medical authorization or provide the insurance company with a recorded statement
Many of the above issues can be true yet you can still have a valid workers’ compensation claim. As an example, just because no one witnessed your workplace accident does not mean the accident didn’t occur and you were not injured. Likewise, simply because you failed to immediately report your workplace accident does not mean you were not seriously injured. Having an experienced Warner Robins workers’ compensation attorney by your side from start to finish can make a huge difference in the outcome of your workers’ compensation claim.

FAQ's
Regarding Workers’ Compensation Claims in Georgia:
-
How is Overtime Factored into Workers’ Compensation Benefits? There is a formula that determines your wage benefits which is equal to the gross total of the 13 weeks prior to the week of your injury. That total is divided by 13, then multiplied by 2/3rds. This gives you the temporary total disability rate in the state of Georgia—with a maximum amount of $675 per week as of 2019. Overtime can be calculated into your gross wages for the purposes of calculating your workers’ compensation amount of weekly wage benefits.
-
Can You Sue After a Work-Related Accident or Illness? You may wonder whether you can sue your employer for an injury or illness that occurred while you were on the job. Workers’ compensation is the exclusive remedy for workplace injuries, meaning even if your employer was negligent, you may not be able to sue. That’s considered the tradeoff of workers’ compensation—no matter whose fault the accident was, you are allowed to recover workers’ compensation benefits. So, in most cases, you cannot sue your employer for your work-related accident or illness. If, however, you were unfairly denied workers’ compensation benefits, your attorney can file suit against your employer’s insurer to prove that you are owed benefits. In rare cases, if a third-party—a person or company other than your employer—was responsible for your work-related accident, you could file a lawsuit against that person or entity for your injuries and lost wages.
